Terms of Service
Effective Date: September 25th, 2025
SCOPE OF SERVICES
Elevated Soundworks offers the following professional audio services:
- Podcast Editing: Basic Edit, Enhanced Production, Premium Production & Polish
- Podcast Management Add-on
- Custom 4-Track Intro/Outro Music
- Monthly Podcast Editing Subscriptions (4 episodes/month)
- Custom Podcast Projects (Flat-rate or Hourly)
- Mixing & Mastering: Standard, Expanded, and Full Production Mixes
- Add-on Services: Vocal Tuning, Time Alignment, Stem Mix Delivery, Rush Delivery
*Each service includes defined turnaround times, revision limits, and overage fees as detailed in our pricing plan.

PAYMENT TERMS
Upfront Payment Required: All services must be paid in full before work begins. Custom projects may require a 50% deposit with the balance due before final delivery. Hourly work requires a 3-hour minimum ($150) upfront.
Accepted Payment Methods: Payments are processed via Stripe, which supports credit cards, Apple Pay, bank transfers, and other regional methods.
Subscription Billing: Subscriptions are automatically billed every 30 days and include 4 episodes per month. Clients may cancel at any time before the next billing cycle.
Late Payments & Grace Periods: A 5-day grace period is provided for late invoices. After 5 days, a 1.5% monthly late fee is applied. Work will be paused until payment is received.
REFUND POLICY
Before Work Begins: Clients may request a full refund if no work has started.
After Work Begins: No refunds are issued once work has started on any service, including subscriptions.
Custom Projects: Deposits are non-refundable once work has begun. If a custom project is canceled mid-way, clients are responsible for any completed work beyond the deposit, billed at $50/hour.

REVISIONS POLICY
*Definition of a Revision: Minor tweaks or adjustments. Significant changes to the structure or scope of the project are considered scope changes and may incur additional fees.
Additional Revisions: Additional revisions beyond those included will be billed at $10 each. Scope changes will be quoted separately.
TURNAROUND TIME & DELIVERY
Standard Turnaround: Most projects are delivered within 48–72 hours, excluding weekends and holidays.
Rush Delivery: 24–48 hour rush turnaround available for an additional $75, subject to availability.
Client Submission Deadline: Files must be submitted by 12 PM PST to begin turnaround same day. Late submissions may delay delivery.
Client Delays: Delays in feedback or materials will pause the timeline.
Holiday & High Volume Delays: Turnaround may be extended during holidays or peak periods. Clients will be notified of any delay.
Force Majeure: Elevated Soundworks is not liable for delays caused by events beyond our control.
FILE STORAGE & RETENTION
Retention Period: Project files are stored for 30 days after final delivery.
Client Responsibility: Clients must download and back up their final files. Elevated Soundworks is not responsible for file loss after 30 days.
Abandoned Files: Files for abandoned or canceled projects are also deleted after 30 days. To resume, a new quote may be required.

INTELLECTUAL PROPERTY & OWNERSHIP
Client Ownership: Upon full payment, clients own the final delivered product for intended use (podcast publishing, music distribution, etc.).
Custom Music: Custom intro/outro tracks are royalty-free and fully owned by the client upon payment.
Work-in-Progress Files: Drafts or DAW sessions are not included unless otherwise agreed and may be billed separately.
Abandoned or Canceled Projects: If a project is abandoned or canceled before final delivery and full payment, Elevated Soundworks retains full rights to any original work created (e.g., custom instrumentals, edits, or compositions).
Portfolio Use: Final published work may be used in our portfolio unless the client requests otherwise in writing.
Third-Party Tools: Client files may be processed using secure AI-assisted tools or third-party software, but will never be used for AI training or public sharing without explicit consent.

CONFIDENTIALITY & PRIVACY
All client files and communications are treated as confidential. Files are used solely for the intended services. Client information is never sold or shared. Final published work may be included in promotional materials unless the client opts out.
LIABILITY & DISCLAIMERS
Elevated Soundworks is not responsible for third-party platform issues, client-side technical problems, or unintended publishing outcomes. Clients must own or license all submitted materials. Elevated Soundworks is not liable for file corruption, client storage errors, or third-party service disruptions. Total liability is limited to the amount paid for the service in question.

SERVICE GUARANTEES
Satisfaction Guarantee: Revisions are included as per your tier. We’ll work within scope to deliver results aligned with your goals.
Delivery Guarantee: Projects are delivered within the promised time-frame if materials are submitted on time. If we delay without notice, we’ll offer a free timeline adjustment or rush upgrade.
Audio Quality Guarantee: All files meet professional loudness and formatting standards. If not, we’ll correct it at no charge.
AGREEMENT ACCEPTANCE & POLICY UPDATES
By purchasing a service from Elevated Soundworks, you agree to these Terms of Service.
